If you were one of the lucky ones who got selected in the H1B lottery, congratulations!
You made it to the first step in the process of getting your H1B. The next step is getting your petition approved. This can take from a couple of days to several months depending on whether you filed with Regular Processing (RP) or Premium Processing (PP), and on whether or not you get a Request for Evidence (RFE) or Notice Of Intent of Denial (NOID). PP will obviously be faster. If your employer filed in RP, you should know that they can still upgrade to PP to expedite the result.
These are the possible scenarios:
- If your petition was filed in PP and you don’t get an RFE, your petition should be approved by May 27th at the latest. This is because USCIS started PP on May 12 and it guarantees a decision within 15 days.
- If your petition was filed in PP and you get an RFE, the processing time will depend on how quickly you send the requested evidence to USCIS. Once USCIS receives it, they will provide a decision within 15 days.
- If your petition was filed in RP and you don’t get an RFE, you will receive the decision from USCIS around August.
- If your petition was filed in RP and you get an RFE, you will need to provide the requested evidence to USCIS. Once USCIS receives it, they will take up to 60 days to respond back. In this case, your petition may not be approved until November or December. In order to avoid further delays, you should respond as quickly as possible to the RFE. At this point, you could also upgrade to PP after to expedite the decision.
